• Marketing Cloud - Marketing automation and campaign management
• Analytics Cloud - Business intelligence and reporting
• Commerce Cloud - E-commerce and order management
• Integration Hub - API and third-party integrations

3. Account Registration

To use certain features of the Services, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription and Payment

4.1 Subscription Plans: OpenDesk offers various subscription plans with different features and pricing. Details of current plans are available on our pricing page.

4.2 Payment Terms: All fees are charged in advance on a monthly or annual basis. You authorize us to charge your designated payment method for all applicable fees.

4.3 Price Changes: We may modify our pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

4.4 Taxes: All fees are exclusive of applicable taxes, which you are responsible for paying.

5. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Services
• Use the Services for any unlawful or fraudulent purpose

6. Intellectual Property

6.1 Our Rights: OpenDesk retains all rights, title, and interest in the Services, including all intellectual property rights. The Services are protected by copyright, trademark, and other laws.

6.2 Your Rights: You retain all rights to your data. By using the Services, you grant us a limited license to use your data solely to provide the Services to you.

7. Data Security

We implement industry-standard security measures to protect your data. However, no method of electronic storage is 100% secure. You acknowledge this risk and agree to take reasonable precautions to protect your account credentials.

8. Service Level Agreement

OpenDesk commits to a 99.99% uptime guarantee for paid subscriptions. Service credits may be issued for downtime exceeding this threshold, subject to the terms of your specific subscription plan.

9. Termination

9.1 By You: You may terminate your account at any time through your account settings or by contacting us.

9.2 By Us: We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENDESK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Garfield County, Colorado.
